The Pennsylvania Supreme Court unanimously ruled to uphold state firearm preemption laws, blocking Philadelphia’s attempt to enact stricter local gun regulations. The 6-0 decision rejected the city’s argument that preemption laws violated residents’ constitutional rights to life and liberty.
Justice Kevin Brobson declared that Philadelphia’s legal team “relied upon general constitutional principles and painted their argument with overly broad strokes,” failing to prove that Article I, Section 1 of the Pennsylvania Constitution granted rights for local gun regulation.
This ruling maintains Pennsylvania’s position among roughly 40 states with similar preemption statutes, preventing cities from creating gun laws stricter than state regulations. The decision blocks Philadelphia’s proposed measures, including permit-to-purchase requirements and one-gun-per-month limits.

Rep. Eric Burlison (R-Mo.) has announced plans to introduce legislation aimed at abolishing the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The measure, previously introduced in 2023, garnered support from multiple House Republicans including Representatives Lauren Boebert and Thomas Massie.
FPC Challenges New York’s Non-Resident Carry Ban
The Firearms Policy Coalition has filed a federal lawsuit challenging New York’s prohibition on firearm carry by out-of-state residents. The lawsuit argues that constitutional rights, including Second Amendment protections, should not be limited by state borders.
