A federal judge ruled New York’s blanket ban on concealed carry on private property unconstitutional, marking another defeat for the state’s expansive gun control laws. U.S. District Court Judge John Sinatra Jr. wrote that the restriction is unconstitutional “at least as to private property open to the public.”
The decision follows a Supreme Court ruling that declared New York’s previous concealed carry permitting requirements unconstitutional. In response, Gov. Kathy Hochul signed the Concealed Carry Improvement Act in July 2022, which gun rights activists argue violates the Second Amendment.
Brandon Combs, president of the Firearms Policy Coalition, praised the decision, calling it “another important victory for Second Amendment rights and another major loss for New York, authoritarian governments, and radical anti-rights organizations.”
