The Second Amendment Foundation (SAF) petitioned the U.S. Supreme Court to hear a case challenging California’s ban on gun shows on public property. SAF argues that the law violates California gun owners’ First and Second Amendment rights.
The petition claims the 9th Circuit Court failed to follow the Supreme Court’s 2022 Bruen decision, which eliminated “judicial balancing tests” for Second Amendment claims. SAF founder Alan M. Gottlieb said California has “essentially ignored” this ruling while “trampling on the First Amendment protections of speech, which is necessary for the commerce of lawful products.”
SAF hopes the Supreme Court will overturn the ban, with Executive Director Adam Kraut stating, “If the state is allowed to continue, neither the First nor Second Amendments are safe from California’s legal choke hold.
