The National Rifle Association has filed a lawsuit challenging the Bureau of Alcohol, Tobacco, Firearms and Explosives’ new “Engaged in the Business” rule, which redefines when individuals must obtain a federal firearms license.

The lawsuit, filed in the U.S. District Court for the Northern District of Alabama, argues that the ATF’s rule exceeds its statutory authority and violates multiple constitutional provisions, including the Second and Fifth Amendments. The NRA contends that the rule could potentially criminalize law-abiding citizens exercising their constitutional rights.

This lawsuit comes after recent Supreme Court rulings that have reined in government agencies’ power to make rules beyond what laws specifically allow. The NRA’s challenge seeks to prevent what it views as an overreach by the ATF in interpreting and applying firearms laws.

The CA Excise Tax is Now In Effect

As of July 1, 2024, California has implemented an 11% excise tax on firearms, parts, and ammunition sales, in addition to the existing 6% sales tax. This presents a significant challenge for California FFLs, who must now manage complex quarterly state payments.
